If you are an average internet user who uses the internet service at his/her home for accessing social media platforms and to browse the web, then you will not most probably exceed the monthly data allowance set by your internet provider. On the other hand, heavy internet users, including the ones who stream plenty of movies and HD video contents on daily basis, will certainly exceed their monthly cap.

Some of the internet providers in the country might be charging the internet users who exceed their monthly data allowance. Reports from several reliable sources indicate that Cox Communications® is also planning to notify their San Diego customers that they will implement an overage charge from the users who use more than one terabyte of data in a month.

Until a few years ago, Cox® and other internet providers in the country used to throttle internet speeds instead of overcharging the customers who exceeded their monthly data limits. A senior analyst, Ian Olgeirson said, “Operators have tried a lot of different ways of going about this, and in almost all cases, it has been sort of a light touch because they recognize this is an important area for them and they don’t really benefit from alienating higher-end customers.”

This new move from Cox Communications®, who is the largest and arguably the fastest internet provider in the San Diego County, has caused panic in the mind of their internet customers. It is reported that Cox® will be charging an extra amount of $10 from their customers for an additional data pack of 50 gigabytes.

Exceeding Monthly Data Limit

However, Cox® is not the only internet provider who is planning to adopt this strategy. Comcast Corporation® and several other telecom companies have already started to charge their customers for exceeding the monthly data limit.

A spokeswoman from Cox Communications® stated that only 2 percent of their San Diego customers blow past their monthly data allowance each month. This means that the recent decision made by Cox® will not affect the majority of their internet customers in San Diego.

“Some people are just heavy users for whatever reason,” she said. “But there are some customers, we think, who have in-home Wi-Fi and maybe they have not secured it with a password. So it may be open and other people might be tapping into it.”

Diehard fans of Cincinnati Bengals and Cleveland Browns who are currently subscribed to AT&T® U-Verse® or DirecTV® might miss the highly anticipated match between the two teams coming Sunday. This is due to the blackout of WBNS-TV (Channel 10) on these two TV services.

WBNS-TV and their sister station WTHR-TV went dark on these two TV services on Sept. 6 (both are currently owned by AT&T®, who is the fastest internet provider in several parts of the country). The blackout of these channels happened due to a dispute over retransmission licensing fees. As per law, satellite, and cable TV providers must negotiate with the local TV stations in order to broadcast their contents.

Reports from several reliable sources indicate that both the parties had held several meetings to resolve the issue. Yet, they were unable to end the dispute. However, DirecTV® and AT&T® U-Verse® customers are still hopeful that the blackout will end before the match begins.

In a recent email, an AT&T® spokeswoman Holly Hollingsworth stated that there has not yet been a progress in the issue since both the local stations “pulled their permission for DirecTV® and U-Verse® to carry WBNS earlier this month, and that remains the situation today.”

On the other hand, the owner of the two local stations, Dispatch Broadcast Group, informed viewers that they are still trying to resolve the issue. The president and general manager of WBNS, John Cardenas said, “It appears AT&T®/DirecTV® doesn’t have the urgency to restore CBS/10TV.”

He added, “We have done big deals with other (pay-TV) providers recently, and so we know what the market is on retransmission consent deals. We gear our negotiations toward that. As a two-station company, we are not setting the market for retransmission consent fees. We do not understand why we have been able to get deals done with other larger operators, but we cannot get this deal with ATT-DTV done.”

It seems that the subscribers of AT&T® U-Verse® and DirecTV® are having a tough time these days, as WBNS is not the only channel, who is having carriage disputes with AT&T®. The telecom company was recently involved in carriage disputes with 17 stations of Meredith Broadcasting, 3 stations of Capitol Broadcasting, 7 stations of American Spirit Media, and over 40 stations of Raycom. However, most of these disputes have been already resolved.

Comcast® recently announced that they have acquired the Internet of Things startup Stringify. The Telco intends to leverage the technology developed by this startup firm for using in its Xfinity Home® services and products as well as in its best internet packages. Previously, Stringify aided Comcast® in developing and setting up of its xFi cloud-based home Wi-Fi management platform, which was rolled out earlier this year.

Stringify announced the acquisition on its recent blog post., stating about carrying out numerous update in its service to make it ready for use by Comcast®. “Our team joins the fast-growing engineering group at Comcast® that develops the technologies behind Xfinity Home® and xFi, Comcast’s new and personalized Wi-Fi experience that provides customers unique control of their home networks,” the blog post reads.

It has made a significant investment in Plume recently, which amounts to about $37.5 million.

Plume is a startup assisting Comcast® in developing its xFi network. It has developed an array of Wi-Fi pods that functions together with broadband gateways in order to extend the wireless signal range inside residential spaces. Moreover, Comcast® has also recently acquired iControl Networks. This new deal has provided them the means to license its home automation systems to other internet providers in the country such as Cox Communications®, Rogers Communications, and numerous cable operators.

Ninth Circuit Court Of Appeals

Recently, the judges in the Ninth Circuit Court of Appeals questioned lawyers of AT&T® and Federal Trade Communications (FTC) regarding whether FTC has the right to prosecute the Telco for “allegedly throttling the subscribers with unlimited wireless data” without sending due notice. AT&T® told the judges the lawsuit is invalid and that FTC cannot enforce a fine since the Telco does not fall under the jurisdiction of FTC.

FTC has appealed a ruling in favor of AT&T® by the Ninth Circuit Court of Appeals last year, and a year on, the lawsuits still remains wide open. The Ninth Circuit Court of Appeals is yet to give a ruling on the present lawsuit as yet. Similar lawsuits have occurred before between AT&T® and FTC.

In 2014, for instance, FTC alleged the Telco had throttled download speed when the subscribers exceeded monthly data caps by 3 to 5 GB. AT&T® dismissed the lawsuit stating that FTC has no authority to prosecute “common carriers”. In fact, Federal Communications Commission’s Net Neutrality rules classify internet providers as “common carriers,” something which FTC failed to dismiss in 2014. As a lawsuit settlement, FTC refunded more than 2.7 million AT&T® subscribers in 2016.

Net Neutrality Rule

Joel Marcus, Deputy General Counsel for Litigation, and acting lawyer of FTC has said that FTC’s interest in the lawsuit with AT&T® strictly applies to data security. “At this point, the FTC is the only game in town in data security,” Marcus said. “But even beyond that you have the problem of the common carrier who sells dietary supplements or used cars or any of the other things the FTC ordinarily gets involved in.”

Marcus also pointed out that it was not the case until earlier this year, when President Donald Trump overhauled the Net Neutrality rule, which FCC passed in 2015. The Net Neutrality rule was enforced under the Obama Administration to correct the loopholes in privacy and data security that existed due to FTC’s “common carrier” exemption.

However, the judges say that the Republican Senate is now working on reversing the 2015 Net Neutrality rules. The reversal may reclassify internet providers as “common carriers”, and if passed, the changes will put some of the best internet providers namely AT&T®, Verizon®, Comcast®, Charter Communications®, and Cox® under the jurisdiction of FTC.

5G And 4G LTE Trials

Charter Communications® has collaborated with Samsung for carrying out 5G and 4G LTE lab and field trials across the United States. The trials will involve evaluating the usage of the 28 GHz millimeter wave spectrum. Besides that, the two companies are also conducting trials in 4G at the 3.5 GHz spectrum using the small cell technology developed by Samsung in outdoor environments.

According to a statement released by the company, “These tests will provide critical information as Charter® prepares to launch a mobile wireless service next year and bring new competition to that marketplace.” Reports say that Charter® will also stress on an ‘inside-out’ strategy, initially centering on wireless solutions inside the home and office, and then finally expand to outdoors.

Previously, Charter® entered into a MVNO agreement with other internet providers such as Verizon Communications®. Later, the Telco announced some details regarding its plans to test and implement 5G network across various regions of the country. The Telco has also applied for the required licenses to undertake trials using 5G in the previous year.

Craig Cowden, SVP of wireless technology at Charter®, said in a statement, “We are pleased to collaborate with Samsung on these trials, which provide Charter® better insight into how our advanced, powered, high-speed network—which currently passes 49 million homes and businesses—can be used to enable 5G services. AT&T U-Verse® customers recently loss access to Fox affiliate WRAZ and Local NBC affiliate WRAL-TV. Reports from several reliable sources indicate that the blackout of these two popular channels is due to a dispute between the parent company of the stations, Capitol Broadcasting, and AT&T®. However, it seems that AT&T®, who is one of the best internet providers in the country, is currently trying to resolve the issues as soon as possible.

In their website, WRAL wrote, “Our channels are currently not airing on AT&T U-Verse®. Capitol Broadcasting Company stations WRAL and FOX 50 are affected and we apologize for the inconvenience to you. While we work to get this resolved, it’s always helpful, for you, the customer, to call AT&T U-Verse® and tell them you expect to get the channels you’re paying them for. That number is 1-800-288-2020.”

The website further said that users could watch the channels anytime over-the-air for free. “You can always watch WRAL/NBC and FOX 50/Fox Network for free in crystal clear HD with an over-the-air antenna, available at local big box stores or get one here. Other ways to watch WRAL: All WRAL newscasts are available live right here on WRAL.com or you can download the free WRAL channel app and stream the newscasts live on Roku, AppleTV and Fire TV,” the web page states.

During the outage of these channels, the TV screens of customers who are currently under AT&T U-Verse® carried the following message:

“The owner of this channel has removed it from the U-Verse lineup despite our request to keep it available to you. Visit att.com/fightingforyou for more information on this station’s return.”

In addition to that, a spokesman from AT&T U-Verse®, Josh Gelinas, blamed the parent company of WRAL for the outage. He added, “Capitol is deliberately stopping WRAL and WRAZ from reaching their homes until Capitol receives a significant increase in fees.”

In their full statement, AT&T® wrote, “We want to get WRAL and WRAZ back into our Raleigh, Durham and Fayetteville customers’ lineups as soon as possible. Doing so requires permission from their owner, Capitol Broadcasting, since FCC rules grant WRAL and WRAZ exclusive control over whether those stations remain available on U-Verse®.”

Officials at AT&T® further said, “Capitol has blocked its stations from reaching our own and other providers’ customers before, while also threatening to disconnect others. Our goal is to resolve this matter quickly and reasonably, and we appreciate our Raleigh, Durham and Fayetteville customers’ patience while we attempt just that.”

Customers who lost access to these couple of channels will miss a few important college football games that will air on Fox and WRAL on the weekend. In addition to that, the NFL football matches on the same channels on Sunday will also be unavailable to customers.

Subscribers can now voice search “YouTube” on their X1 remotes and the app will instantly launch on Stream TV. Additionally, voice searching “show me clips from a news channel on YouTube” will allow Xfinity® subscribers stream channel-specific videos within the YouTube app. The same feature can be used to stream other on-demand YouTube videos under the “On Demand Menu” section of Stream TV as well.

When internet is down, commerce for many South Florida businesses and individuals, who depend on the internet to get things done, also goes down. As South Florida is recovering from the Hurricane Irma, television and internet providers are facing questions from customers on service restoration. Many users complained that they are not getting any clear answers and some were not able to get through.

A Comcast® customer named Rodriguez tweeted to @comcastcares and got a message that her service will be restored by Sept. 18 at 03:30 pm. Yet she said, “That seems unreasonable to me.”

Outages are widespread on internet, phone, and television services. Many of the outage could be linked to electric outages. The Twitter and Miami Herald feeds of AT&T® and Comcast® received many complaints from users with power but no TV or internet services.

Comcast® spokeswoman, Mindy Kramer said that the network that feeds and distributes their services in the Miami area include communications equipment that is dependent on commercial power, which is down due to the hurricane.

“As of Tuesday morning, we have been able to restore power to some but not all of the equipment that services customers in the Miami-metro area. We are working very closely with FPL so they can prioritize these critical facilities and restore commercial power service to them as quickly as possible,” Kramer said.

“Our facilities in South Florida have been running on generators since the storm began and unfortunately everyone is need of the same fuel resources. We have been doing our best to refuel these generators so that our facilities are able to stay functioning without commercial power. Kramer further said that Comcast® also suffered damages as lines were cut; in fact, the Telco suffered extensive destruction in Florida Keys. Kramer said that except for in the Keys, “We expect our plant to be restored quickly from what our assessments show so far.” She said that power is restored to one piece of critical equipment, “but we need them all to come back up.”

She added that as soon as commercial power supply is restored to the Miami Metro plant of Comcast®, the consumer services would resume. “The situation is very challenging and we know being without Xfinity® internet, TV or phone service is frustrating for our customers. We are doing everything possible to be able to restore services as quickly as we can.”
